شروط الاستخدام

من نحن

يشغّل جليس [الاسم النظامي للجهة المشغّلة، وعنوانها، ورقم سجلها التجاري]. للتواصل: [بريد الدعم].

في هذه الشروط، «نحن» تعني جليس، و«أنتم» تعني أحد الوالدين أو وليّ الأمر الذي يستخدم التطبيق مع أطفاله.

ما يقدّمه جليس

حكايات عربية مصوّرة بنص مشكول وقراءة صوتية ومعانٍ للكلمات وأسئلة اختيارية في نهاية كل حكاية، للقراءة مع الأطفال. واجهة التطبيق بالعربية أو بالإنجليزية، والحكايات ومعاني كلماتها وقراءتها الصوتية بالعربية.

ما يُفتح من الحكايات في التطبيق:

• للجميع، مع حساب الأسرة أو دونه: حكايات مجانية كاملة، وتبقى كذلك.
• مع حساب الأسرة، وإنشاؤه مجاني: تتبع مواضع القراءة والكتب المكتملة كل طفل على أجهزة الأسرة كلها، ومنه يُشترى الاشتراك.
• مع الاشتراك، أو في أيامه الأولى دون دفع: تُفتح كل الحكايات، وما يُضاف منها.

حكايات الاشتراك لا تأتي مع التطبيق: تُنزَّل الحكاية من خوادمنا أول مرة تُفتح على الجهاز، ثم تبقى عليه وتُقرأ دون اتصال ما دام الاشتراك قائمًا (انظروا «الاشتراك»).

يبيّن التطبيق عند كل حكاية ما يفتحها. قد نضيف حكايات أو نعدّلها أو نسحب بعضها، وقد نغيّر ما يُفتح في كل مستوى [يحدد المراجع القانوني ما يلزم من إخطار المشتركين].

نراجع الحكايات قبل نشرها، وإن رأيتم فيها ما يحتاج إلى تصحيح فأخبرونا من «أبلغ عن مشكلة».

حساب الأسرة

• حساب الأسرة لأحد الوالدين أو وليّ الأمر ممن بلغ [السن النظامية]. الأطفال لا ينشئون حسابات، ويستخدمون التطبيق بإشراف أسرهم.
• يُدخل الحساب برقم الجوال أو البريد الإلكتروني أو بحساب Apple أو Google. أنتم مسؤولون عن وسيلة الدخول هذه، وعن رمز الأهل الذي تختارونه.
• يتسع الحساب لـ ١٢ طفلًا، ويعمل على كل أجهزة الأسرة التي يُدخل منها إليه.
• يمكنكم حذف الحساب في أي وقت من منطقة الأهل، كما تبيّن سياسة الخصوصية.

الاشتراك

الاشتراك اختياري، وتنطبق عليه الشروط التالية:

• اشتراك جليس اشتراك واحد للأسرة: يفتح كل الحكايات لكل الأطفال في حساب الأسرة، على كل جهاز يُدخل منه إلى الحساب.
• يلزم له حساب الأسرة، ويُشترى من داخل التطبيق، في صفحة الاشتراك خلف بوابة الأهل، عبر App Store أو Google Play، ويحصّل المتجر ثمنه من حسابكم لديه عند تأكيد الشراء، أو عند نهاية فترة التجربة إن بدأ بها. السعر والعملة ومدة الاشتراك (شهريًا أو سنويًا) كما يعرضها المتجر قبل تأكيد الشراء، شاملة الضرائب المطبّقة مثل ضريبة القيمة المضافة.
• فترة التجربة: أول ١٤ يومًا من الاشتراك دون دفع، للمشتركين الجدد الذين يتيح لهم المتجر ذلك (في App Store: مرة واحدة لكل حساب Apple). تُفتح فيها كل الحكايات. وإن لم يُلغَ الاشتراك قبل نهايتها في الموعد الذي يحدده المتجر (في App Store: قبل نهايتها بـ ٢٤ ساعة على الأقل)، يتحوّل تلقائيًا إلى اشتراك مدفوع بالخطة التي اخترتموها، ويُحصَّل ثمنه. وإن اشتريتم خطة أخرى أثناء فترة التجربة، فقد ينهي المتجر ما بقي منها وفق قواعده.
• التجديد التلقائي: يتجدد الاشتراك تلقائيًا في نهاية كل مدة بالسعر الذي يعرضه المتجر حينها، ما لم يُلغَ قبل التجديد في الموعد الذي يحدده المتجر (في App Store: قبل نهاية المدة بـ ٢٤ ساعة على الأقل، ويُحصَّل ثمن التجديد خلال الـ ٢٤ ساعة السابقة لنهايتها).
• الإلغاء: من إعدادات الاشتراكات في المتجر، وتصلون إليها أيضًا من «إدارة الاشتراك» في صفحة الاشتراك. في iPhone وiPad: «الإعدادات»، ثم اسمكم، ثم «الاشتراكات». وفي Google Play: صورة الحساب، ثم «الدفعات والاشتراكات»، ثم «الاشتراكات». يسري الإلغاء في نهاية المدة الجارية، مدفوعةً كانت أو فترة التجربة، وتبقى الحكايات مفتوحة حتى نهايتها كما يبلغنا بها المتجر.
• حذف التطبيق أو حذف حساب جليس لا يلغي الاشتراك لدى المتجر.
• الاسترداد: يتولاه المتجر وفق سياساته (من App Store: بطلب إلى Apple). ولا يمسّ ذلك ما تمنحكم أحكام حماية المستهلك في بلدكم من حقوق لا يجوز التنازل عنها. [يضيف المراجع القانوني ما يلزم وفق نظام التجارة الإلكترونية وأنظمة حماية المستهلك في البلدان التي يُتاح فيها التطبيق].
• المشاركة العائلية: لا يُتاح الاشتراك عبر «المشاركة العائلية» في App Store، بل تتشاركه الأسرة بحسابها في جليس، على كل جهاز يُدخل منه إليه. ولا يُربط الاشتراك الواحد إلا بحساب أسرة واحد.
• تغيير السعر: يخبركم المتجر قبل أي زيادة، وقد يطلب موافقتكم وفق قواعده، ولا يسري التغيير إلا من مدة لاحقة.
• القراءة دون اتصال: تُقرأ حكايات الاشتراك المنزّلة دون اتصال ما دام التطبيق قد تأكد من خادمنا خلال آخر ٣٠ يومًا أن الاشتراك قائم، وما لم تمضِ على نهاية مدته، كما عرفها التطبيق، أكثر من ٣ أيام. وبعد ذلك، أو إن أُعيدت ساعة الجهاز إلى الوراء، تنتظر حكايات الاشتراك اتصالًا واحدًا ليتأكد التطبيق من الاشتراك. أما الحكايات التي تُقرأ دون حساب فتبقى مفتوحة دائمًا.
• انتهاء الاشتراك لا يحذف قراءة الأطفال: تبقى المواضع والحكايات المكتملة والإجابات، وتعود الحكايات التي يفتحها الاشتراك مقفلة. وحين يجيب خادمنا بأن الاشتراك انتهى، يزيل التطبيق ما نُزِّل منها على الجهاز في الحال. أما إن أقفلها التطبيق وهو دون اتصال، فتبقى على الجهاز مقفلة ٣٠ يومًا على الأقل من حين أقفلها، ثم يزيلها التطبيق أول مرة يُشغَّل بعدها؛ وإن تأكد الاشتراك قبل إزالتها فُتحت من جديد دون تنزيل. وإن عاد الاشتراك بعد إزالتها، نُزِّلت الحكايات من جديد حين تُفتح.

الاستخدام المسموح

جليس للاستخدام الشخصي والعائلي غير التجاري. ولا يجوز:

• نسخ الحكايات أو رسومها أو قراءتها الصوتية، أو نشرها أو بيعها أو إتاحتها لغيركم؛
• تجاوز ما يُفتح من الحكايات، أو محاولة الوصول إلى بيانات أسرة أخرى أو إلى خوادمنا بغير طريق التطبيق؛
• إرسال بلاغات مسيئة أو مزعجة، أو الإكثار منها (يقبل التطبيق لكل أسرة ١٠ بلاغات في اليوم).

الملكية الفكرية

الحكايات والرسوم والقراءة الصوتية والتطبيق واسم جليس وشعاره ملك [للجهة المشغّلة] أو لمن رخّص لها. نمنحكم ترخيصًا شخصيًا محدودًا غير حصري وغير قابل للنقل لقراءتها في التطبيق وعلى الموقع، ولتنزيل ما يفتحه اشتراككم منها على أجهزة أسرتكم لقراءته في التطبيق، ما دمتم تلتزمون هذه الشروط.

توفّر الخدمة

نعمل على أن يكون جليس متاحًا وصحيحًا، لكننا لا نضمن خلوّه من الانقطاع أو الأخطاء. بعض الخصائص يحتاج إلى اتصال بالإنترنت، مثل تسجيل الدخول والمزامنة والاشتراك، وفتح حكاية من حكايات الاشتراك أول مرة على كل جهاز، والتأكد من الاشتراك مرة كل ٣٠ يومًا على الأقل لتبقى حكاياته مفتوحة دون اتصال.

نتيح جليس في المتاجر لأسر في أنحاء العالم، إلا في البلدان والمناطق التي لا نتيحه فيها، وقد نضيف بلدانًا أو نوقفه في بعضها. وعليكم أن تستعملوه وفق أنظمة بلدكم.

[حدود المسؤولية: يصوغها المراجع القانوني وفق الأنظمة السعودية، مع ما لا يجوز استبعاده في قوانين حماية المستهلك في البلدان الأخرى].

إيقاف الحساب

لكم أن تتوقفوا عن استخدام جليس وتحذفوا الحساب في أي وقت. ولنا أن نعلّق حسابًا أو نوقفه عند مخالفة هذه الشروط مخالفة جسيمة، بعد إخطاركم متى أمكن.

النظام الواجب التطبيق

تخضع هذه الشروط لأنظمة المملكة العربية السعودية [يؤكد المراجع القانوني ذلك، ويحدد الجهة المختصة بالنزاعات]. وإن كنتم مستهلكين مقيمين في بلد آخر، فلا يحرمكم ذلك من الحماية التي تمنحكم إياها الأحكام التي لا يجوز الاتفاق على خلافها في قانون بلدكم [يؤكد المراجع القانوني الصياغة].

إذا نزّلتم التطبيق من App Store، تنطبق كذلك اتفاقية ترخيص المستخدم النهائي القياسية من Apple، المنشورة على www.apple.com/legal/internet-services/itunes/dev/stdeula/ [أو اتفاقية خاصة يعدّها المراجع القانوني].

تغيير هذه الشروط

إذا غيّرنا هذه الشروط ننشر النسخة الجديدة هنا مع تاريخ سريانها، ونخبركم في التطبيق قبل أي تغيير جوهري.

Who we are

Jalees is operated by [legal name of the operating entity, its address and commercial registration number]. Contact: support_jalees@elementum.com.sa.

In these terms, "we" means Jalees, and "you" means the parent or guardian who uses the app with their children.

What Jalees offers

Illustrated Arabic stories with vowelled text, narration, word meanings and optional questions at the end of each story, for reading with children. The app's interface is in Arabic or English; the stories, their word meanings and their narration are in Arabic.

Which stories open in the app:

• For everyone, with or without a family account: free stories in full, and they stay so.
• With a family account, which is free to create: reading places and finished books follow each child across the family's devices, and the subscription is bought from it.
• With the subscription, or in its first days without payment: every story opens, and every story added.

Subscription stories do not come with the app: a story is downloaded from our servers the first time it is opened on a device, then stays on it and reads without a connection while the subscription lasts (see "The subscription").

The app shows, for each story, what opens it. We may add, edit or withdraw stories, and may change what opens at each level [the legal reviewer sets any notice owed to subscribers].

We review stories before publishing them; if you see something that needs correcting, tell us with "Report a problem".

The family account

• The family account belongs to a parent or guardian who has reached [the legal age]. Children do not create accounts and use the app under their family's supervision.
• You sign in with a mobile number, an email address, or an Apple or Google account. You are responsible for that sign-in method and for the parent PIN you choose.
• An account holds up to 12 children and works on every device of the family that signs in to it.
• You can delete the account at any time from the parent area, as the Privacy Policy explains.

The subscription

The subscription is optional; these terms apply to it:

• The Jalees subscription is one subscription for the family: it opens every story for every child in the family account, on every device signed in to the account.
• It needs a family account and is bought in the app, on the subscription page behind the parent gate, through the App Store or Google Play; the store charges your account with it when you confirm the purchase, or when the trial period ends if it starts with one. The price, currency and period (monthly or yearly) are as the store shows them before you confirm the purchase, including applicable taxes such as VAT.
• Trial period: the first 14 days of the subscription without payment, for new subscribers to whom the store offers it (on the App Store, once per Apple Account). Every story opens during it. If the subscription is not cancelled before it ends, by the time the store sets (on the App Store, at least 24 hours before it ends), it turns automatically into a paid subscription on the plan you chose, and is charged. If you buy another plan during the trial period, the store may end what is left of it under its rules.
• Automatic renewal: the subscription renews automatically at the end of each period at the price the store then shows, unless it is cancelled before renewal by the time the store sets (on the App Store, at least 24 hours before the end of the period, and the renewal is charged within the 24 hours before it ends).
• Cancelling: in the store's subscription settings, which "Manage subscription" on the subscription page also opens. On iPhone and iPad: Settings, then your name, then Subscriptions. On Google Play: your profile picture, then Payments & subscriptions, then Subscriptions. Cancellation takes effect at the end of the current period, paid or trial, and stories stay open until it ends, as the store reports it to us.
• Deleting the app or your Jalees account does not cancel the subscription with the store.
• Refunds are handled by the store under its policies (for the App Store, by asking Apple). This does not affect the rights that consumer protection law in your country gives you and that cannot be waived. [The legal reviewer adds what the E-Commerce Law and the consumer protection rules of the countries where the app is offered require].
• Family Sharing: the subscription is not offered through the App Store's Family Sharing; the family shares it through its Jalees account, on every device signed in to it. One subscription is linked to one family account only.
• Price changes: the store tells you before any increase and may ask for your consent under its rules, and a change applies only from a later period.
• Reading offline: downloaded subscription stories read without a connection as long as the app has confirmed with our server within the last 30 days that the subscription is active, and no more than 3 days have passed since the end of its period, as the app last learned it. After that, or if the device's clock is set back, the subscription stories wait for one connection so that the app can check the subscription. The stories anyone reads without an account always stay open.
• When a subscription ends, the children's reading is not deleted: positions, finished stories and answers remain, and the stories the subscription opened are locked again. When our server answers that the subscription has ended, the app removes those downloaded to the device at once. If the app locked them while offline, they stay on the device, locked, for at least 30 days from when it locked them, and the app removes them the first time it starts after that; if the subscription is confirmed before they are removed, they open again without a new download. If the subscription returns after they are removed, the stories download again when opened.

Permitted use

Jalees is for personal, family, non-commercial use. You may not:

• copy the stories, their illustrations or narration, or publish, sell or make them available to others;
• get around what opens, or try to reach another family's data or our servers other than through the app;
• send abusive or disruptive reports, or too many of them (the app accepts 10 reports a day for each family).

Intellectual property

The stories, illustrations, narration, the app, and the Jalees name and logo belong to [the operating entity] or its licensors. We grant you a personal, limited, non-exclusive, non-transferable licence to read them in the app and on the website, and to download those your subscription opens to your family's devices to read in the app, while you comply with these terms.

Availability

We work to keep Jalees available and correct, but we do not promise that it will be free of interruptions or errors. Some features need an internet connection, such as sign-in, sync and the subscription, opening a subscription story for the first time on each device, and checking the subscription at least once every 30 days so that its stories stay open offline.

We offer Jalees through the stores to families around the world, except in the countries and regions where we do not make it available, and we may add countries or stop offering it in some. You are responsible for using it in line with your country's laws.

[Limitation of liability: to be drafted by the legal reviewer under Saudi law, with what the consumer protection laws of other countries do not allow to be excluded].

Ending an account

You may stop using Jalees and delete the account at any time. We may suspend or close an account for a serious breach of these terms, after telling you when we can.

Governing law

These terms are governed by the laws of the Kingdom of Saudi Arabia [to be confirmed by the legal reviewer, with the forum for disputes]. If you are a consumer living in another country, this does not deprive you of the protection given to you by the rules of your country's law that cannot be set aside by agreement [the legal reviewer confirms the wording].

If you downloaded the app from the App Store, Apple's standard Licensed Application End User License Agreement, published at www.apple.com/legal/internet-services/itunes/dev/stdeula/, also applies [or a custom agreement prepared by the legal reviewer].

Changes to these terms

If we change these terms, we will publish the new version here with its effective date, and tell you in the app before any material change.
